Islam sets out specific inheritance rules for Muslims – who are your beneficiaries, how much do they each receive, how much can you gift to others.
These rules are not automatically applied when you pass away in the UK and it is therefore important to make a Will to ensure that your affairs are dealt in line with Islamic guidelines.
Without a Will, your affairs will be dealt with automatically under the domestic law – the Rules of Intestacy – which differ from Islamic rules of Inheritance.
What can be included in your Will:
- Funeral arrangements
- Executors
- Guardians for minor children
- Specific gifts amounting to a maximum of a 1/3 of your estate
- Kaffarah (a penalty payment to charity, note that this will depend on the school of thought you follow and you should seek independent advice on the amount to leave, if any).
- How the rest of your estate will be split under Islamic law based on who survives you
You also have the option to create a trust in your Will, applying the Islamic principles in a manner that can be tax-efficient.
