You may, for example, have tripped over a paving stone or fallen from scaffolding. You may have been in a car crash or had an accident at work. About making a personal injury claimTo obtain compensation for an injury or illness, this must be caused by the mistake or ‘fault’ of someone else. However, even if you are partly to blame, you may still have a case. Claims must be brought within strict time limits – usually 3 years from the accident or for a child by the time he or she is 21, although there are exceptions. What will I get?There are two aspects to this. Some of the compensation covers your pain and suffering. This is assessed with the assistance of expert medical evidence. There are guidelines referred to by the court for the amounts payable in respect of particular injuries. The rest covers all your financial losses and expenses – both past and future. This can include loss of earnings and travel costs to and from hospital appointments. Who will pay my costs?The main options are: No win No fee – for many clients this is the best option. Legal Expenses Insurance – you may have an insurance policy to pay your legal costs, perhaps with your car or home insurance. Time LimitsThe law states that court proceedings have to be issued within a certain time known as the limitation period. The time limits are strict and set out in the Limitation Act 1980. If you do not comply with the limitation period that applies to your claim, you are likely to lose forever the chance to make your claim. Most personal injury claims must be issued at court within three years of the date of the accident. For accidents to children the claim must be issued no later than their 21st birthday. Road Traffic AccidentsRoad traffic accidents are unfortunately very common. One or more vehicles may be involved and drivers and/or passengers may be injured. Some drivers are uninsured. Witnesses can be hard to chase. Sometimes there is an argument about who was to blame for the accident. It is important that we trace and interview witnesses as soon as possible. Very often we are able to overcome difficulties such as uninsured or untraced drivers and lack of witnesses. Accidents at WorkAccidents in the workplace are all too common. Millions of pound are paid every year by way of compensation injury claims.
